An Ordinance adopting the U.S. Green Building Council’s Leadership in Energy and Environmental Design (LEED) Green Building Rating System for certain building types within the City.
WHEREAS, the City of Evanston’s Strategic Plan adopted March 27, 2006 (hereinafter “the Plan”) defines our City’s vision as: “Creating the most Livable City in America”; and
WHEREAS, the Plan further states that our Natural Resources Vision is for the City to be known as “the Green City” and commits the City to embracing the best ecological practices and policies in our government, services and infrastructure; and
WHEREAS, Goal # 4 of the Plan is to “create and maintain functionally appropriate, sustainable, accessible high quality infrastructure and facilities” with specific objective “E” of this Goal being “to better manage our buildings, prepare & implement a long-range and comprehensive facility maintenance plan”; and
WHEREAS, Goal # 5 of the Plan is to protect and optimize the City’s natural resources and built environment, leading by example through sustainable practices and behaviors, with specific objective “A” of this Goal being to “review current City policies and procedures to identify and improve sustainable and environmentally-friendly practices for the City and its citizens” and specific objective “B” being to “identify and utilize new practices that will improve the quality of life that will enhance the City’s sustainability”; and
WHEREAS, the US Mayors Climate Protection Agreement, adopted by resolution through City Council and signed by the Mayor on October 23, 2006 states “We will strive to meet or exceed Kyoto Protocol targets for reducing global warming pollution by taking actions in our own operations and communities”; and
WHEREAS, buildings account for 38% of the CO2 emissions per year. The U.S. Green Building Council’s LEED Green Building Rating System directly addresses CO2 emissions from buildings and their use; and
WHEREAS, buildings consume approximately 30% of the total energy and approximately 60% of electricity generated in the United States; and
WHEREAS, the City of Evanston has stated that a public benefit of planned development includes: “The substantial incorporation of generally recognized sustainable design practices and/or building materials to promote energy conservation and improve environmental quality, such as level silver or higher LEED (leadership in energy and environmental design) certification.” Evanston Ordinance – Planned Development, Sec. WHEREAS, the City of Evanston should promote resource-efficient design of new buildings in order to increase their energy efficiency, save financial resources, save natural resources and reduce the negative environmental impact of demolition, construction, and operation of buildings; and
WHEREAS, the United States Green Building Council (USGBC), a non-profit, nationally recognized association with membership representing all segments of the building industry, including architects, manufacturers, government agencies, and environmentalists, has created the LEED Green Building Rating System™ that provides specific principles and practices that may be applied to building design, construction, and operation, and which enable a building to receive certification from the USGBC as a “green” building for achieving certain sustainable standards of energy efficiency, sustainable site development, water savings, materials selection, and indoor environmental quality; and
WHEREAS, in adopting the requirements set forth in this ordinance, the City Council recognizes the significant long-term economic, health and environmental benefits to the City and its residents through the use of LEED criteria; and
WHEREAS, using LEED criteria will ensure that through all stages of their lifecycles, City buildings will have a less negative impact on the environment and a positive impact on the health and productivity of its citizens and employees as well as the financial strength of the City.
THEREFORE, BE IT RESOLVED THAT THE CITY OF EVANSTON DOES HEREBY ORDER:
I. That all newly constructed commercial and multi-family buildings over 10,000 square feet in the City and all city-owned or city-financed buildings over 10,000 square feet shall employ the version of the LEED for New Construction and Major Renovations (LEED-NC) in effect 180 days prior to the date of application for a building permit and that each such new building shall achieve the following level of LEED certification:
a. For City-Owned or City-Financed Facilities over 10,000 square feet: Silver Rating b. For all commercial and multi-family buildings over 10,000 square feet in the City: Silver Rating or higher
II. That all interior renovation or build-out improvements for all commercial and multi-family buildings over 10,000 square feet and all city-owned or city-financed facilities over 10,000 square feet shall employ the version of the LEED for Commercial Interiors (LEED-CI) in effect 180 days prior to application for a building permit and that each project shall achieve the following level of LEED certification:
a. For City-Owned or City-Financed Facilities over 10,000 square feet: Silver Rating or higher b. For all commercial and multi-family buildings over 10,000 square feet: Silver Rating or higher
III. That prior to the commencement of any work, all developers subject to I and II above shall post a performance bond with the City to ensure compliance with the LEED requirements; the City Manager or his/her designee shall determine the amount of the performance bond and determine when a default, in whole or in part, had occurred.
All monies collected from defaults, in whole or in part, will be deposited in the Sustainable Evanston Fund.
IV. That a Sustainable Evanston fund be established; that the Fund shall be used exclusively to support the Office of Sustainability, to provide technical assistance and plan review for proposed green buildings as well as for education, training and outreach to the public and private sectors on green building practices. The Fund shall be administered by the City Manager.
V. That design and construction of all new or replacement low sloped roofs over 5000 square feet for City-Owned, City-Financed, commercial, or multi-family buildings in the City shall be Energy Star compliant.
VI. Landmark or historic structures in a historic district shall comply with the standards for review set forth in the preservation ordinance (Section 2-9-9).
VII. That the City require and, budget permitting, fund training in green building industry practices for all city project managers and operation and maintenance staff. who are involved with the supervision of building design, construction and operation.
VIII. That the City of Evanston encourage the application of LEED principles to any building or facilities project not otherwise subject to this ordinance, whenever it is practicable.
